Transforming the Mental Health System in Texas

Presented by: Melissa Rowan, Partner at Wertz&Rowan

In 2011, Texas started its first Delivery System Reform Incentive Payment (DSRIP) program under an 1115 Transformation Waiver. In 2017, Texas renewed the 1115 waiver with changes to DSRIP including decreasing funding over a 5-year time period and ending on October 2021. DSRIP is now close to 30% of all CMHC funding and transition planning for the future is underway. This session will discuss the phases of DSRIP including successes and challenges, and the options Texas has going forward to create a sustainable system of care beyond 2021.

Let’s Talk About Sex: Reducing the Risk of Non-Employee Sexual Misconduct

Presented by: Attorney Ron Zimmet

Sexual misconduct by employees and non-employees has been the basis of the most frequent lawsuits against behavioral healthcare providers for at least the last 50 years. Assuming that high quality care is the best risk  management, this presentation addresses approaches to reducing the risk of lawsuits based on claims that adult and child patients, foster children and foster parents engaged in sexual misconduct. Among the topics discussed are initial risk screening of patients and foster children, comprehensive risk assessment, gathering adequate information for assessments and treatment planning, adequately supervising patients and foster children, appropriate disclosures to foster parents, and sharing critical information with staff and other treaters.

Executive Compensation—The Ultimate Balancing Act

Presented by: Rob Rogers, Managing Consultant at Findley, Inc.

This session will look at emerging trends in executive remuneration, particularly in the health care industry. There will be a discussion of compensation philosophy development, the appropriate role of governance, legal issues, and considerations for the design of short and long-term performance/tenure awards. We will examine the balancing act—constructing a package that meets the needs of the executive, and yet is reasonable and consistent with the needs of the stakeholders.

Jail-Based Competency Restoration: A Texas-Sized Undertaking

Presented by: StarCare Specialty Health System CEO Beth Lawson and Emergence Health Network Chief Clinical Officer Chrystal L. Davis

In 2001, only 16% of all Texas state hosipital commitments were forensic; in 2017, that number grew to 61%. This rapid shift has strained an already fragile and aging infrastructure. In addition, this growth coupled with a dramatic decrease in the number of available inpatient beds per Texas citizen has resulted in a very large number of people in Texas jails who are incompetent to stand trial. Please join this highly interactive session to learn about Texas’ efforts to launch a state-funded, jail-based competency restoration program, told from two Local Mental Health Authority perspectives.
